The Volstead Act was officially titled “An act to prohibit intoxicating beverages, and to regulate the manufacture, production, use, and sale of high-proof spirits for other than beverage purposes, and to insure an ample supply of alcohol and promote its use in scientific research and in the development of fuel, dye, and other lawful industries.” You can read both the 18th Amendment and the Volstead Act at the bottom of the page. But Congress overrode his veto on the same day, October 28, 1919.
He cited both constitutional and ethical grounds. President Woodrow Wilson vetoed the bill. Some people cursed his name, others praised it, but everyone knew it. Nevertheless, Prohibition transformed the name of an otherwise obscure legislator into a household word. But its author was largely Wayne Wheeler of the Anti-Saloon League. He chaired the Senate Judiciary Committee and sponsored it. The law is called the Volstead Act after Congressman Andrew J. Penalties for violations also needed to be specified.
What “intoxicating liquors” and other terms meant needed definitions. It stated that “the manufacture, sale, or transportation of intoxicating liquors within, the importation thereof into, or the exportation thereof from the United States and all territory subject to the jurisdiction thereof for beverage purposes is hereby prohibited.” And that “Congress and the several States shall have concurrent power to enforce this article by appropriate legislation.” Andrew Volstead The 18th Amendment was very brief and general. Otherwise, the criminal justice system couldn’t enforce National Prohibition. The Volstead Act was needed in order to implement the Eighteenth Amendment.
